Update Regarding the 2024 Title IX Regulations

Background

On April 19, 2024, the Department of Education’s Office for Civil Rights issued new regulations under the federal nondiscrimination law known as Title IX. These regulations detail for institutions the Department of Education’s expectations and requirements for addressing allegations of discrimination based on sex; the regulations are set to go into effect August 1, 2024. Consistent with the new Title IX regulations, the University has been working diligently over the last few months to update and revise the University’s Title IX policies and procedures. 

Injunction

On July 16, 2024, the U.S. District Court for the District of Kansas granted a temporary injunction on behalf of private plaintiffs, Young America’s Foundation (YAF) and Female Athletes United (FAU), preventing the Department of Education from implementing or enforcing the 2024 Title IX regulations in four states as well as at any college or university attended by any member of either of these organizations.

91³Ô¹ÏÍø University was identified and named as having a student who is a member of one of the private plaintiffs. In addition to 91³Ô¹ÏÍø University, the list included approximately 700 schools, spanning all 50 states.  

For now, 91³Ô¹ÏÍø University will pause any updates to its Title IX Policy and maintain its current Title IX policy and grievance procedure which is compliant with the 2020 Title IX regulations. However, the injunction may be lifted, in whole or in part, at any moment. Accordingly, we have revised policies and procedures to comply with the 2024 Title IX regulations, in the event that the 2024 Title IX regulations become effective.

Current Policies and Procedures in Effect

91³Ô¹ÏÍø University remains committed to providing a safe and welcoming campus environment for all members of its community. 

As noted above, unless and until the new 2024 regulations apply to 91³Ô¹ÏÍø University, the University’s current  apply to all matters concerning sexual harassment, sexual assault, dating violence, domestic violence, and stalking that fall under Title IX’s jurisdiction.
